TRANSFER ORDER: In his 1 Petition for Writ of Habeas Corpus Pursuant to 28 U.S.C. § 2241, Petitioner challenges his ongoing detention by U.S. Immigration and Customs Enforcement at the Otero County Processing Center in New Mexico. Although Petitioner was initially detained in New York, it is well settled that § 2241 requires a habeas petitioner challenging his present physical confinement to file a petition in the district of confinement. See Rumsfeld v. Padilla, 542 U.S. 426, 443 (2004); Trump v. J.G.G., 604 U.S. 670, 672 (2025). Venue in this District is therefore improper. The Clerk of Court is directed to transfer this action to the U.S. District Court for the District of New Mexico and to close this matter. Ordered by Judge Orelia E. Merchant on 2/27/2026. (TSB)
