TEXT ORDER: This matter comes before the Court upon pro se Petitioner Dragan Nikitovic's Emergency Petition for Writ of Habeas Corpus under 28 U.S.C. 2241 and Motion for Temporary Restraining Order and Preliminary Injunction. D.E. 1 ("Petition & TRO"). Petitioner is a prisoner confined in FCI Fort Dix in Fort Dix, Jersey, and challenges the statutory authority for his final removal order. See id. In accordance with Rule 4 of the Rules Governing 2254 Cases, applicable to § 2241 cases through Rule 1(b), scope of the Rules, this Court has screened the Petition for dismissal and determined dismissal without a full answer is not warranted. Respondents shall file an expedited answer to the Petition and response to the TRO within 14 days of this Order. The expedited answer shall include Petitioner's projected prison release date and indicate whether Respondents intend to release and remove Petitioner prior to completion of his sentence. Pursuant to the All Writs Act, 28 U.S.C. § 1651, Respondents are enjoined from transferring Petitioner from New Jersey while this habeas proceeding is pending.
