ELECTRONIC ORDER: ELECTRONIC NOTICE OF JUDICIAL SCREENING AND STANDING ORDER. Judicial screening of this case is pending. See Rule 1(b) and Rule 4 of the Rules Governing Section 2254 habeas cases. The Court will order Respondent to file an answer, if necessary, after screening is complete. It is therefore ORDERED that (1) no motions for appointment of counsel shall be filed until the Court has completed the screening process, (2) all discovery in this case is stayed until Respondent is ordered to file an answer or until further order of the court, (3) no amendments or supplements to the habeas corpus petition shall be filed without prior Court approval, and (4) any motion to amend the habeas petition must be accompanied by a complete proposed amended petition on the required form. It is further ORDERED that Petitioner must promptly notify the Court in writing of any change of address by filing a written Notice of Change of Address with the Clerk of the Court. Failure to provide updated address information may result in the dismissal of the case for failure to prosecute or follow court order under Fed. R. Civ. 41(b). Finally, the Court intends to transfer this case to the San Angelo Division of this District. Because the Court is transferring the case, it will not address Grisel Stefanny Lopez Dam's ability to file a § 2241 petition on Petitioner's behalf under 28 U.S.C. § 2242. See Whitmore v. Arkansas, 495 U.S. 149, 163 (1990) (explaining that next friend standing is not granted automatically; the filer first must provide an adequate explanation such as inaccessibility, mental incompetence, or other disability why the real party in interest cannot appear on his own behalf to prosecute the action). ELECTRONIC Order: ELECTRONIC ORDER OF TRANSER: Robert Bohorquez-Arcinegas, an ICE detainee at the Eden Detention Center in Concho County, filed--through his purported next friend Grisel Stefanny Lopez Dam--a pro se habeas petition under 28 U.S.C. § 2241, in which he appears to challenge his detention. Because § 2241 petitions must be filed in the division where the petitioner is confined, venue is improper in this division. Pursuant to 28 U.S.C. § 1406(a), and in the interest of justice, the Court TRANSFERS this case to the San Angelo Division of the Northern District of Texas. 28 U.S.C. § 124(a)(4); N.D. Tex. Misc. Order No. 6 ("[M]agistrate judges are authorized... to sign orders transferring cases filed by prisoners... to the proper or more appropriate district or division."). NOTICE OF DEFICIENCY AND ORDER. The Clerk is directed to change the caption of this case to reflect that the only proper petitioner is Roberth Bohorquez-Arciniegas, who is proceeding pro se. Grisel Stefhanny Lopez Dam will be removed as a party to the case. As a result, if Petitioner Bohorquez-Arciniegas wishes to pursue these habeas claims, he must file an amended petition and either pay the $5.00 filing fee or file an application to proceed in forma pauperis within 30 days. The amended petition must be signed. If Bohorquez-Arciniegas fails to timely file an amended petition, the Court will dismiss this action for want of prosecution without further notice. The Clerk is directed to mail a copy of this order to Lopez Dam. But she will not receive any further notice of the proceedings here. The Clerk is also directed to mail Petitioner Bohorquez-Arciniegas a blank Section 2241 form marked, amended and stamped with this cause number, and an application to proceed in forma pauperis.
