ELECTRONIC ORDER: ELECTRONIC NOTICE OF JUDICIAL SCREENING AND STANDING ORDER. Judicial screening of this case is pending. See 28 U.S.C. § 1915(e)(2). It is therefore ORDERED that (1) service of process shall be withheld pending completion of judicial screening, (2) no motions for appointment of counsel shall be filed until the Court has completed the screening process, (3) all discovery in this case is stayed until the Court enters a scheduling order, (4) no amendments or supplements to the complaint shall be filed without prior Court approval, and (5) any motion to amend the complaint must be accompanied by a complete proposed amended complaint on the required form. It is further ORDERED that Plaintiff must promptly notify the Court in writing of any change of address by filing a written Notice of Change of Address with the Clerk of the Court. Failure to provide updated address information may result in the dismissal of the case for failure to prosecute or follow court order under Fed. R. Civ. 41(b). Finally, the Court intends to transfer this case to the San Angelo Division of this District. Because the Court is transferring the case, it will not address Desiree Thien's ability to file a § 2241 petition on Petitioner's behalf under 28 U.S.C. § 2242. See Whitmore v. Arkansas, 495 U.S. 149, 163 (1990) (explaining that next friend standing is not granted automatically; the filer first must provide an adequate explanationsuch as inaccessibility, mental incompetence, or other disabilitywhy the real party in interest cannot appear on his own behalf to prosecute the action). NOTICE OF DEFICIENCY AND ORDER. The Clerk is directed to change the caption of this case to reflect that the only proper petitioner is Lang Thanh Do, who is proceeding pro se. Desiree Thien will be removed as a party to the case. If Petitioner Lang Thanh Do wishes to pursue these habeas claims, he must file an amended petition on the proper form within 30 days. The amended petition must be signed. If Do fails to timely file an amended petition, the Court will dismiss this action without prejudice for want of prosecution, without further notice. The Clerk is directed to mail a copy of this order to Desiree Thien. But she will not receive any further notice of the proceedings here. The Clerk is also directed to mail Petitioner Lang Thanh Do a copy of the original petition and supporting documents, Dkt. No. 3, and a blank Section 2241 form marked amended and stamped with this cause number.
