TEXT ORDER re 1 Petition for Writ of Habeas Corpus. To maintain the status quo, and solely so that the Court can make an informed decision about its authority to issue relief and whether any relief that it has the power to issue should be granted, the respondents are temporarily enjoined from removing the petitioner from the United States. Additionally, so that the petitioner can fully participate in these proceedings, the respondents also are enjoined, with the exception of any transfer to the District of Massachusetts, see Docket Item 1 at 9, from transferring the petitioner outside the Western District of New York. TEXT ORDER: The respondents have informed the Court that the petitioner "voluntarily departed the United States on November 19, 2025," and has thus been released from the administrative custody of the Department of Homeland Security ("DHS"). See Docket Item [16-1] at ¶ 6. Because the only relief that the petitioner sought was release from DHS custody, see Docket Item 1 at 10, he "is no longer subject to the condition that caused his alleged deprivation, and as a result, this Court lacks subject matter jurisdiction to further examine the merits of the petition," see Harvey v. Holder, 63 F. Supp. 3d 318, 321 (W.D.N.Y. 2014). The respondents' motion to dismiss, Docket Item 16, is therefore GRANTED. Moreover, in light of the petitioner's voluntary departure, his pending motion for the Court to order his transfer to a detention facility within the Western District of New York, Docket Item 9, is DENIED without prejudice as moot.
