ORDER Upon review of the Petition for Writ of Habeas Corpus 1, it is ORDERED that Petitioner shall SERVE Respondents with a copy of the Petition and accompanying papers, along with a copy of this Order, by e-mail and by overnight mail, on or before March 2, 2026. Petitioner shall promptly file proof of such service on the docket, and counsel for Respondents shall promptly enter their notices of appearance. Based upon a preliminary review of the Petition, the facts of this case appear to be controlled by the Courts recent analysis in Aleman Hernandez v. Baltazar, No. 1:25-cv-3688-SKC-SBP, 2025 WL 3718159, at *1 (D. Colo. Dec. 23, 2025). Consequently, within five days of service, Respondents shall ANSWER the Petition and SHOW CAUSE why the Petition should not be granted. In their ANSWER, Respondents must first address whether the present case differs factually or legally from Aleman Hernandez in any material respect, and if so, shall specify the material differences. In addition, Respondents shall file a complete copy of the administrative file relevant to Mr. Ruiz Diaz. IT IS FURTHER ORDERED Pursuant to the All Writs Act, and in order to preserve the Court's jurisdiction, Respondents SHALL NOT REMOVE Petitioner from the District of Colorado or the United States unless or until this Court or the Court of Appeals for the Tenth Circuit vacates this Order.SO ORDERED by Judge S. ORDER re: 9 Amended Application for Writ of Habeas Corpus, filed by Jose Luis Ruiz Diaz. The Court has reviewed the Amended Petition, and finds that it is materially similar to Magistrate Judge Susan B. Prose's opinion in Merchan-Pacheo v. Noem, No. 1:25-cv-03860-SBP, 2026 WL 88526, at *15 (D. Colo. Jan. 12, 2026), which this Court considers to be both thoughtful and persuasive. Consequently, on or before March 13, 2026, Respondents shall RESPOND to the Amended Petition and SHOW CAUSE why the Amended Petition shall not be granted based on the analysis in Merchan-Pacheco. ORDER granting 13 Motion to Amend/Correct/Modify. The Court rules on the Motion without awaiting a response. The Motion is GRANTED and the Court's prior Order 12 is modified as follows: 1. Once Mr. Ruiz Diaz posts his $40,000 bond, Respondents shall immediately release Petitioner from detention with any reasonable conditions of supervision as authorized by the immigration judge.2. If Mr. Ruiz Diaz posts his $40,000 bond, he shall remain in Respondents' temporary custody for the sole purpose of Respondents effectuating his return to Orlando, Florida.3. If Mr. Ruiz Diaz posts his $40,000 bond, Respondents SHALL transport Mr. Ruiz Diaz back to Orlando, Florida, at their own expense, within 36 hours of the date and time of the processing of his $40,000 bond.4. To effectuate the purpose of this Court's Order and to allow Mr. Ruiz Diaz to return home, Respondents are also temporarily enjoined from detaining Mr. Ruiz Diaz pursuant to 8 U.S.C. § 1226 for a period of fourteen days from the date he arrives back in Orlando, Florida.5.
