MINUTE ORDER (Text Only Entry) issued by Courtroom Deputy for Senior District Judge John A. Mendez on 02/18/2026: Plaintiffs, who are student-athletes on the UC Davis Equestrian team, filed suit on February 9, 2026, challenging the elimination of the UC Davis Equestrian program. ECF No. 1 . Plaintiffs bring only state law claims, but allege the Court has diversity jurisdiction pursuant to 28 U.S.C. § 1332 over this matter. Id. ¶ 144. However, Plaintiffs are citizens of California, Ohio, and Oregon, while Defendants are citizens of California. Id. ¶¶ 145-46. Diversity jurisdiction requires complete diversity of all parties, i.e., "the citizenship of each plaintiff [must be] different from that of each defendant." Hunter v. Philip Morris USA, 582 F.3d 1039, 1043 (9th Cir. 2009). Such diversity is lacking here. Thus, this case is DISMISSED for lack of jurisdiction. See Ho v. Russi, 45 F.4th 1083, 1086 (9th Cir. 2022) (noting a district court may dismiss a litigant's claims without notice where lack of jurisdiction appears on the face of the complaint and is obviously not curable).
