Judge Brian E. Murphy: ELECTRONIC ORDER entered. This Petition is GRANTED. Respondents acknowledge that “this Court’s prior decisions control the result in this case if the Court adhere to those decisions.” Dkt. 8 at 1 (citing Diaz Martinez v. Hyde, No. 25-cv-11613-BEM, 2025 WL 2084238 (D. Mass. July 24, 2025), and Aguiriano Romero v. Hyde, No. 25-cv-11631-BEM, 2025 WL 2403827 (D. Mass. August 19, 2025)). For the reasons stated in those cases, the Court finds that Petitioner’s detention is governed, if at all, by 8 U.S.C. s. 1226. Respondents suggest, upon that finding, that “the only appropriate remedy for this Court to award is a bond hearing before an Immigration Judge.” Id. at 3. However, Petitioner has already received a bond hearing and was granted bond under section 1226. See Dkt. 1 para. 9; Dkt. 8 at 2. Accordingly, Petitioner is hereby ordered released, consistent with the August 21, 2025 decision of the Immigration Judge.(MBM) (Entered: 10/10/2025)
