Judge Indira Talwani: ELECTRONIC ORDER entered. Petitioner alleges that in or about December 2021, following his 2021 expedited removal, he re-entered the United States and surrendered to U.S. Border Patrol agents. Am. Pet. par. 1415 [ 6 ]; Cordeiro de Souza Aff. ECF 4 par. 3 [[6-1]]. He asserts further that he was detained for approximately fifteen days and then released. Am. Pet. par. 15 [ 6 ]; Cordeiro de Souza Aff. ECF 4 par. 3 [[6-1]]. In response, Respondents acknowledge that "Petitioner subsequently re-entered the United States without inspection or admission by an immigration officer" but have not addressed or disputed Petitioner's claim that he surrendered to U.S. Border Patrol agents and, despite having been previously removed from the United States, was released. See Resp. 2 [ 11 ]. Respondents are directed to supplement their response, no later than Thursday, April 23, 2026, detailing Petitioner's immigration status and conditions of his release after his December 2021 re-entry to the United States.
