ORDER. The Petition for Writ of Habeas Corpus (Doc. No. 1 ) is GRANTED as to Petitioner's INA violation claim. The Court finds that Petitioner is subject to detention pursuant to 8 U.S.C. § 1226(a) and may not be denied a custody redet ermination solely on the basis that he is detained under 8 U.S.C. § 1225(b) (2)(A). Petitioner's Second Motion for Temporary Restraining Order (Doc. No. 8 ) and Motion to Expedite (Doc. No. 20 ) are DENIED as moot.
