TEXT ORDER denying 16 Respondents' Motion to Dismiss and granting Petitioner's request for Respondents' to hold a bond hearing before an immigration judge. On September 25, 2025, Petitioner filed a Petition for a Writ of Habeas Corpus, contending, inter alia, that his detention is unlawful under 8 U.S.C. § 1226(a) because he "has not been, and will not be, provided with a bond hearing as required by law." ECF Nos. 1 par. 27; 13 par. 28. Pending before the Court is Respondents' Motion to Dismiss, wherein they argue that the Petition must be dismissed due to Petitioner's failure to exhaust his administrative remedies by requesting a bond haring and, in any event, that Petitioner is lawfully detained under 8 U.S.C. § 1225(b). The Court heard oral argument from counsel for both parties on October 10, 2025.The Court declines to require exhaustion of administrative remedies under the circumstances and concludes that Petitioner is being detained under § 1226(a). Therefore, Petitioner is entitled to a bond hearing. See 8 U.S.C. § 1226(a) (stating that noncitizens detained under § 1226(a) may be released "on... bond" or "conditional parole"); 8 C.F.R. § 1236.1(d)(1).Furthermore, given that Petitioner is detained pursuant to § 1226(a), the Court finds that the denial of a bond hearing violates his procedural due process rights. All three of the factors set forth in Mathews v. Eldridge, 424. U.S. 319 (1976) weigh decidedly in Petitioner's favor. For the reasons stated above and in a forthcoming written decision that will fully discuss the Court's rationale, Respondents' Motion to dismiss 16 is denied and the Amended Petition for a Writ of Habeas Corpus 13 is granted, but only with respect to Petitioner's request for a bond hearing before an immigration judge. Respondents shall conduct a constitutionally adequate bond hearing on or before October 23, 2025, where the Government bears the burden of proving by clear and convincing evidence that Petitioner's continued detention is justified based on his dangerousness to the community or risk of flight. B.S. v. Joyce, No. 22-CV-9738 (PKC), 2023 WL 1962808, at *4-5 (S.D.N.Y. Feb. 13, 2023). Respondents shall file a status report on or before October 24, 2025, stating whether Petitioner has been granted a bond hearing in compliance with this Order.
