ORDER re 20 Amended Petition for Writ of Habeas Corpus. The Court informed the parties that this case was closed by its Opinion and Order issued on January 29, 2026. In that Opinion, the Court instructed Petitioner both as to his obligation to establish that his removal is not reasonably foreseeable and as to the proper mechanism for refiling (by filing an amended petition along with a motion to reopen). Petitioner ignored these instructions. Petitioner raises the same arguments in his amended petition that he raised in his original petition. He again relies on the amount of time he has been detained post-final-order of removal (again, arguing that the length of his detention has exceeded 6 months by aggregating the periods of time he has spent in detention) and again relies on the Coulibaly Affidavit to support his argument that there is no reasonably foreseeable likelihood of effectuating the outstanding order of removal entered against him. Essentially, there is no new information contained within the amended petition that would alter the Court's analysis and conclusion in its Opinion and Order entered on January 29, 2026. As stated by the Court, because Petitioner has been detained for less than six months, he must overcome the default presumption that his detention remains reasonable, and he cannot do so by simply pointing to the lack of evidence regarding the foreseeability of his removal put forth by Respondents. Accordingly, this case will remain closed. Once Petitioner can provide good reason to believe that his removal is not reasonably foreseeable then he may file another amended petition along with a motion to reopen this case.
