ORDER TO ANSWER: Respondents Noem, Lyons, and Tsoukaris are dismissed without prejudice from this matter because the proper respondent in a petition brought under 28 U.S.C. § 2241 is the warden of the facility where the detainee is currently being held. The Clerk shall serve copies of the Petition (ECF No. 1 ), and this Order, upon Respondent Rokosky by regular mail, with all costs of service advanced by the United States. The Clerk shall forward a copy of the Petition, and this Order, to Chief, Civil Division, United States Attorney's Office via email. The Government shall provide Petitioner with a bond hearing before an immigration judge who shall assess whether Petitioner presents a flight risk or danger to the community within ten days. Petitioner's motion seeking a temporary restraining order (ECF No. 2 ) is DENIED WITHOUT PREJUDICE in light of this Order. TEXT ORDER: The Court is in receipt of Petitioner's motion to enforce (ECF No. 5 ) this Court's February 21, 2026, Order (ECF No. 4 ). This Court already ordered the Government not to transfer Petitioner out of New Jersey prior to the completion of the bond hearing process. (See ECF No. 4 at pg. 2.) Moreover, the burden in a bond hearing pursuant to 8 U.S.C. § 1226(a) remains on the petitioner at all times. See Borbot v. Warden Hudson Cnty. Corr. Facility, 906 F.3d 274, 278-79 (3d Cir. 2018).
