TEXT ORDER: The Court has reviewed the Petition for Writ of Habeas Corpus filed by Petitioner, Irvin Bautista Sanchez, who is presently detained at the Elizabeth Contract Detention Facility in New Jersey. (ECF No. 1.) Petitioner is a native of Mexico and has resided in the United States since 2002. He is a recipient of Deferred Action for Childhood Arrivals ("DACA"), is married to a U.S. citizen, and is the parent of a minor U.S. citizen child with significant medical needs. Petitioner alleges that, notwithstanding his long-term lawful presence in the United States, his compliance with criminal court-imposed conditions following a non-monetary release in November 2025, and his lack of any prior criminal convictions, he was arrested by U.S. Immigration and Customs Enforcement on February 5, 2026, inside a courthouse without notice, any individualized custody determination, or a warrant. Petitioner asserts that his continued detention is arbitrary and unlawful, effected without due process of law, and that administrative remedies--such as an Immigration Court bond hearing--are unavailable to him due to prevailing BIA precedent. (See ECF No. 1 1-16.) Petitioner seeks issuance of a writ of habeas corpus directing his immediate release. Accordingly, it is ORDERED that Respondents shall SHOW CAUSE, no later than Monday, March 2, 2026, why the Petition for habeas corpus relief should not be granted. Petitioner may file a reply brief in support of the Petition within three (3) business days after the filing of Respondents' answer.
