ORDER by Magistrate Judge Susan Prose on February 28, 2026. Upon review of Petitioner's 1 Application for Writ of Habeas Corpus (the "Petition"), which requests, inter alia, that the court grant the Petition, "[e]njoin Respondents from transferring Petitioner outside the jurisdiction of the District of Colorado pending resolution of this case," and "[i]ssue a Writ of Habeas Corpus ordering Respondents to immediately release Petitioner," it is ORDERED that Petitioner shall serve Respondents with a copy of the 1 Petition, and accompanying papers, along with a copy of this Order, by e-mail and overnight mail, on or before March 2, 2026. Petitioner shall promptly file proof of such service on the docket, and counsel for Respondents shall promptly enter their notices of appearance. Within seven days of service, Respondents shall RESPOND to the 1 Petition and SHOW CAUSE why the Petition shall not be granted. It is further ORDERED that the parties shall file a completed Magistrate Judge consent form (ECF No. 3 ) on or before March 9, 2026. MINUTE ORDER: Before the Court is Respondents' Motion to Vacate the Court's Order. ECF No. 12 . In it, Respondents raise two issues: first, that they "do not have the documents and have requested that a new EAD card be issued to Petitioner," id. at 5, and second, they contend that the Court erred in ordering Respondents to provide Petitioner with a pre-deprivation bond hearing in the future, id. at 6. Regarding this first issue, the parties are ORDERED to submit a joint status report by March 19, 2026, explaining whether Petitioner has, in fact, received the documents, as well as any other steps Respondents have undertaken beyond those outlined in their motion to locate and/or return them, as well as an update as to the status of the "new EAD card" they seek to issue to Petitioner. Id. at 5. Second, Petitioner SHALL FILE a response brief, not to exceed 10 pages in length, also by March 19, 2026, responding to the second issue that Respondents raise: the propriety of the Court's order regarding a pre-deprivation bond hearing, as well as-should Petitioner's documents be returned-whether his petition is moot.
