Report and Recommendation recommending that because Section 1225(b) is inapplicable to Petitioner, the dismissal of his appeal pursuant to Section 1225(b)(2)(A) and Matter of Yajure Hurtado was in error. I therefore recommend the District Cour t grant Chavez's Petition and require Respondents hold a hearing no more than five business days thereafter to determine whether Petitioner is entitled to discretionary bond pursuant to Section 1226(a) and consistent with this Court's determination.
