***DISREGAR ENTRY, ENTERED IN ERROR***Minute Entry for proceedings held before Magistrate Judge Brian C. Bajew. INITIAL PRETRIAL & SCHEDULING CONFERENCE held on 07/01/2026. The Court reviewed the purpose of the hearing pursuant to FRCP 16(b) and (c), the factual background of the case, and the basis for jurisdiction. The Court inquired as to the status of settlement negotiations. The Court questioned Counsel for Defendant Velocity Commercial Capital, LLC, Noah Meek as to whether he had entered a notice of appearance. Attorney Meek stated that he was not sure but that he was covering this hearing for his colleague and counsel of record, Jacob Michael Stephens. The Court advised Mr. Meek to file a notice of appearance. The Court then turned to the proposed scheduling order in this case. Agreement was reached as to all dates. The Court will issue a scheduling order. The scheduling order will be modified only upon a showing of good cause. Counsel stated that both parties initial disclosures have been provided. The Court emphasized the importance of conferring before filing opposed motions and of providing the Court with prompt notification of settlement. The Court directed the parties to review the District Judges court rules, available on the Courts website. A written scheduling order will follow. The Court addressed the issue of the Plaintiffs pending Motion for Referral to ADR and noted that, because the scheduling order will contain an order to mediate, the Court will recommend the Motion be denied as moot.
