TEXT ORDER -The Court has reviewed the Petition for Writ of Habeas Corpus filed by Petitioner, Daniel Alexander Lizarralde Castro, who is presently detained at Delaney Hall Detention Center in New Jersey. (ECF No. 1.) Petitioner is a native and citizen of Colombia who entered the U.S. in December 2022. Following his apprehension by immigration authorities, Petitioner was released from custody pursuant to a grant of humanitarian parole under 8 U.S.C. § 1182(d)(5)(A) to pursue asylum relief. He timely filed an application for asylum with U.S. Citizenship and Immigration Services. Petitioner alleges that, notwithstanding his compliance with the conditions of parole and his pending application for relief, he was detained during a routine check-in. He further asserts that the Department of Homeland Security and the Executive Office for Immigration Review have determined that he is subject to mandatory detention without affording him a pre-deprivation hearing, rendering his present custody unlawful. (See ECF No. 1 1-3). Petitioner seeks issuance of a writ of habeas corpus directing his immediate release. Accordingly, it is ORDERED that Respondents shall SHOW CAUSE, no later than Thursday, February 26, why the Petition for habeas corpus relief should not be granted. Petitioner may file a reply brief in support of the Petition within three (3) business days after the filing of Respondents' answer. Petitioner shall not be removed from the District of New Jersey during the pendency of these proceedings. So Ordered by Judge Karen M. Williams on February 19, 2026.
