Judge Brian E. Murphy: ELECTRONIC ORDER entered. Petitioner states that he has been detained by Immigration and Customs Enforcement (“ICE”) without his required daily medication and states that his access to medical treatment while in detention is “uncertain.” Dkt. 1 paras. 6-7; see also Dkt. 7 . Respondents do not answer this allegation, instead demurring that “Petitioner’s allegations challenging his medical treatment while in ICE’s custody are outside of the scope of habeas relief.” Dkt. 10 at 1-2 n.1. However, an allegation of “unmet serious medical need” causing “current [or] future harm” may sound in habeas, pending other considerations. See Gomes v. US Dep’t of Homeland Sec., Acting Sec’y, 460 F. Supp. 3d 132, 146 (D.N.H. 2020). Accordingly, pursuant to R. Gov. s. 2254 Cases 7(a), Respondents are directed to expand the record by end of day, February 25, 2026, to address this allegation. (MBM) (Entered: 02/25/2026)
