TEXT ORDER: This matter comes before the Court upon Petitioner Luis Guillermo Cative Rojas's Amended Petition for Writ of Habeas Corpus under 28 U.S.C. 2241. D.E. 6 ("Amended Petition"). Petitioner challenges his mandatory detention by immigration authorities without a bond hearing as unlawful and seeks immediate release. In accordance with Rule 4 of the Rules Governing 2254 Cases, applicable to § 2241 cases through Rule 1(b), scope of the Rules, this Court has screened the Amended Petition for dismissal and determined dismissal without an answer is not warranted. Respondents shall file an expedited answer to the Amended Petition within 7 days. In that Answer, Respondents shall inform the Court whether they stipulate that Petitioner has no criminal record. Pursuant to the All Writs Act, 28 U.S.C. § 1651, Petitioner shall not be transferred pending this habeas proceeding. The Clerk's Office is ordered to REOPEN the case. TEXT ORDER: This matter comes before the Court upon Petitioner Luis Guillermo Cative Rojas's Amended Petition for a Writ of Habeas Corpus under 28 U.S.C. § 2241, D.E. 6 ("Amended Petition"), challenging his detention by immigration authorities under 8 U.S.C. § 1225(b) as unlawful. Respondents filed an answer to the Petition. D.E. 9 ("Answer"). Respondents submit Petitioner is lawfully detained without a bond hearing under 8 U.S.C. § 1225(b)(1)(B)(ii). Answer at 2-3. This case presents similar material factual allegations to those in this Court's prior decision in Rojas v. Immigr. & Customs Enf't, No. 26-2414, 2026 WL 788723, at *1 (D.N.J. Mar. 20, 2026) and prior decisions in this district, including Rodriguez v. Rokosky, No. 25-17419, 2025 WL 3485628, at *1 (D.N.J. Dec. 3, 2025) (collecting cases), and Cifuentes v. Soto, No. 25-18029, 2025 WL 3771380, at *3 (D.N.J. Dec. 31, 2025), where the Court held the petitioner's detention violated the statute and due process.Therefore, it is ORDERED that the Amended Petition, D.E. 6, is GRANTED. In light of Respondents' failure to demonstrate a lawful basis for detention under § 1225(b)(1), and consistent with the Court's authority to "dispose of the matter as law and justice require," 28 U.S.C. § 2243, release is the appropriate remedy. Respondents shall release Petitioner by 5:00 p.m. on 4/10/2026. If Respondents subsequently arrest Petitioner by warrant under 8 U.S.C. § 1226(a), they must comply with 8 C.F.R. § 236.1(c)(8), (d)(1).
