(IN CHAMBERS) ORDER by Judge Margo A. Rocconi: The Report and Recommendation is hereby WITHDRAWN. In accordance with this Court's Order Requiring Response to Petition [Dkt. 4], Respondents filed an Answer to the Petition on March 4, 2026 [Dkt. 11]. In their Answer, Respondents "request the Court to dismiss" the Petition for lack of prosecution in light of Petitioner's withdrawal of his request for a bond hearing. Answer at 3:13-14. Although Petitioner did file a reply [Dkt. 13] to Respondents' Response [Dkt. 12] to the District Judge's Order to Show Cause re: Preliminary Injunction [Dkt. 10], as of the date of this Order, Petitioner has not filed a reply to Respondents' Answer to the Petition. See Order Requiring Response to Petition "Par. 6". Petitioner is hereby ordered to file such a reply within 14 days of the date of this Order. Failure to file a reply may be deemed as consent to the dismissal of the Petition as moot, and/or for failure to prosecute. Any reply should address (1) whether Petitioner is, as Respondents have suggested, a member of the Maldonado-Bautista class; (2) whether Petitioner has, as of the date of this Order, participated in a bond hearing; (3) the effect, if any, of Petitioner's apparent withdrawal of his request for a bond hearing; and (4) whether this Court should stay the Petition pending a renewed request by Petitioner for a bond hearing.
