MINUTE ORDER The Court has reviewed the Respondents Consolidated Response. 17 . In addition to arguing that Petitioner is properly detained under 8 USC 1225(b)(2)(A)), Respondents argue that Petitioner is ineligible for bond under 8 USC 1226(c)(1)(A) because his conviction to a controlled substance offense renders him inadmissible under 8 USC 1182(a)(2)(A)(II). Although Petitioner acknowledges that he was convicted of simple possession and has pending low-level drug-use charges in Colorado state court, this argument is not addressed in Petitioners filings. 1, 8 . The Court respectfully requests that Respondents file a reply, addressing this argument, specifically, as well as any other points it wishes to respond to, no later than Monday, November 3, 2025. Specifically, the Court would like to know Petitioners position on whether Petitioners conviction or other conduct renders him ineligible for bond under 8 USC 1226(c), and what impact the Respondents assertion has on the relief sought in this case. In other words, even if the Court finds that Petitioner is wrongfully detained under 8 USC 1225(b)(2)(A), why should it order Petitioners release or a bond hearing, as requested, where Respondent contends that he is ineligible for bond under a separate statutory provision that it could or would invoke?
