Cota on 4/9/2026 RECOMMENDING that Petitioner's 1 petition for writ of habeas corpus be GRANTED as Petitioner's detention violates due process; that Petitioner Stanley Efr an Jovel Moran, A-226-062-721, be RELEASED IMMEDIATELY from Respondents' custody upon the same conditions as his prior release, with his belongings. Respondents shall not impose any additional restriction on him, such as electronic monitoring, u nless that is determined to be necessary at a future pre-deprivation/custody hearing; that Respondents be ENJOINED and RESTRAINED from re-arresting or re-detaining Petitioner absent compliance with constitutional protections, including 7 day notice a nd a hearing before a neutral fact-finder where Respondents show: (a) there are material changed circumstances which demonstrate that there is a significant likelihood of Petitioner's removal in the reasonably foreseeable future, or (b) Responde nts demonstrate by clear and convincing evidence that Petitioner poses a danger to the community or a flight risk. At any such hearing, Petitioner shall be allowed to have counsel present. Referred to Judge Dena M. Coggins. ORDER signed by District Judge Dena M. Coggins on 4/21/2026 ADOPTING 14 Findings and Recommendations in Full and GRANTING 1 Petition for Writ of Habeas Corpus as detention violate due process. Respondents are ORDERED to IMMEDIATELY RELEASE petit ioner Stanley Efran Jovel Moran 226-062-721 from custody upon the same conditions as prior release, with ALL belongings. The government shall not impose any additional restrictions, such as electronic monitoring, unless that is determined to be neces sary at a future pre-deprivation/custody hearing and if the government seeks to re-detain Petitioner, it must provide no less than 7 days' notice to petitioner and must hold a pre-deprivation bond hearing before a neutral arbiter, at which Petit ioner's eligibility for bond must be considered and allowed to have counsel present. Within 3 days of this order, respondents are DIRECTED to file a notice certifying compliance with this order and the court is DIRECTED to enter judgment in favor of petitioner and close this case.
