By Deputy Clerk: Karen Walker.A virtual Status Conference is set for Thursday, February 26, 2026, at 11:30 A.M. in Reno Courtroom 5 before Judge Miranda M. Du. The hearing will be conducted by Zoom Video Conference. The parties are directed to contact the courtroom administrator, Karen Walker, at (775) 686-5918 or Karen_Walker@nvd.uscourts.gov, by Wednesday, February 25, 2026, to provide the e-mail address of all counsel who will be attending the hearing. The following Zoom Video Conference Instructions shall be adhered to as follows:Instructions and zoom invite to the scheduled hearing will be sent via e-mail at least ONE (1) day prior to the hearing to the participants e-mail provided to the Court.1. MINUTES OF PROCEEDINGS - Virtual Status Conference held on 2/26/2026 before Judge Miranda M. Du. Crtrm Administrator: Karen Walker; Pla Counsel: Celeste Bacchi and Laura Barrera; Def Counsel: Christian Ruiz and Ashlee Hesman; Court Reporter: Kathy French; Time of Hearing: 11:30 a.m.; Recording start and end times: 11:06 a.m. - 12:20 p.m.; Courtroom: 5. The Court addresses counsel regarding today's status conference and notes that the government did not comply with the Court's Minute Order (ECF No. 9) and did not timely file the status report. The Court questions Respondents' counsel regarding the non-compliance and was advised by Ms. Hesman, counsel for Respondent Mattos, that the government's counsel is not in attendance on the Zoom. The Courtroom Deputy reaches out to government's counsel by e-mail regarding the non-appearance at the status conference and provides the Zoom link information. Ms. Bacchi, counsel for Petitioner, advises the Court she received notification from government counsel, Mr. Ruiz, who indicated that he went to the Las Vegas Courthouse for the hearing. The Courtroom Deputy called Mr. Ruiz from the courtroom so he could appear at today's status conference. The Court notes for the record, that counsel for Petitioner, Ms. Hesman, and the Court waited 25 minutes for the government counsel to appear at today's proceedings.The Court asks Mr. Ruiz regarding his failure to comply with court orders with respect to timely filing the status report and following instructions/procedures regarding the virtual status conference. In addition, the Court noted that Mr. Ruiz failed to file a notice of appearance. Mr. Ruiz apologizes to the Court and provides an explanation. The Court admonishes Mr. Ruiz that failure to follow two court orders is unacceptable.Mr. Ruiz orally provides new information regarding Petitioner's status, alleging Petitioner was transferred to Louisiana before the Petition was filed in this case and therefore moves to dismiss and/or transfer the petition due to venue/jurisdiction. The Court hears from Ms. Bacchi. After hearing from counsel, the Court orders the following:1. Mr. Ruiz is directed to arrange for Petitioner's counsel to speak with Mr. Rizo, either by video or phone, by Friday, February 27, 2026;2. Counsel is directed to file a status report by Monday morning, March 2, 2026, confirming Petitioner spoke with his counsel;3. Mr. Ruiz is directed to have a conference with his clients regarding this order. If the government contends that the case is not in the proper venue, a motion with supporting evidence must be filed by Thursday, March 5, 2026;4. The Court further enjoins Respondents from deporting Petitioner until a motion regarding venue is resolved and/or a stipulation is filed; 5. Petitioner's oral request for a 14-day extension to amend the petition is granted. All corresponding deadlines are extended accordingly; and6. Mr. Ruiz is directed to assist Petitioner's request for recordings and documents from Petitioner's immigration proceedings.
