ORDER: This matter comes before the Court upon Petitioners Emergency Motion for Temporary Restraining Order (the Motion). Dkt. 2. In the Motion, Petitioner seeks an order prohibiting Respondents from moving Petitioner outside of this Courts jurisdiction or removing him from the United States during the adjudication of his habeas petition. Id. Pursuant to the Courts authority to preserve its jurisdiction under the All Writs Act, it is hereby ORDERED that Respondents and Respondents officers, agents, servants, employees, and attorneys, as well as other persons acting in concert with them are hereby ENJOINED from removing the Petitioner from this judicial district for at least SEVEN (7) DAYS to permit the assigned district judge to review the case. 28 U.S.C. § 1651; F.T.C. v. Dean Foods Co., 384 U.S. 597, 603 (1966) (The All Writs Act, 28 U.S.C. § 1651(a), empowers the federal courts to issue all writs necessary or appropriate in aid of their respective jurisdictions and agreeable to the usages and principles of law.); and it is FURTHER ORDERED that other matters related to this case will be handled by the assigned district judge.(See order for details).
