Judge Richard G. Stearns: ELECTRONIC ORDER entered re 6 Response to Petition for Writ of Habeas Corpus - 2241 filed by Pam Bondi, Patricia Hyde, Kristi L Noem, Todd Lyons, Antone Moniz. Petitioner Joao Vitor Barcelos Santos entered the United States without inspection at fifteen years old on November 19, 2016. Following his entry he was apprehended, processed, and released. On January 30, 2018, petitioner filed a Form I-589, Application for Asylum and for Withholding of Removal. On January 8, 2026, Barcelos Santos was detained by Immigration and Customs Enforcement (ICE) at his home and placed at Plymouth County Correctional facility. Barcelos Santos has challenged his detention and seeks immediate release.The court orders that ICE facilitate a bond hearing for him before an Immigration Judge (consistent with the standards outlined in Hernandez-Lara v. Lyons, 10 F.4th 19 (1st Cir. 2021)), as soon as practicable, but in no case more than seven days from the date of this Order (by 3/4/26). (MZ) (Entered: 02/25/2026)
