ORDER. The Court has ordered this preliminary relief in numerous habeas challenges to immigration detention, and will order this relief here. Therefore, to protect the status quo and preserve this Court's jurisdiction, the Court GRANTS the habeas petition only insofar as respondents are hereby enjoined from removing petitioner from the United States or transferring him out of Colorado unless or until this Court or the Court of Appeals for the Tenth Circuit vacates this order or the case is terminated. At this time, the Court takes no action with respect to the remainder of the relief sought in the habeas petition. To the extent they have not done so yet, no later than Wednesday, February 18, 2026, counsel for petitioner is directed to: (1) serve respondents with a copy of the Petition along with a copy of this Order, by email and overnight mail; and (2) promptly file proof of such service on the docket. Counsel for respondents shall promptly enter notices of appearance, and, within 14 days of service, respondents are ORDERED TO SHOW CAUSE as to why the Petition should not be granted by releasing petitioner, by Judge R. Brooke Jackson on 2/17/2026. (ccuen, ) (Entered: 02/17/2026)

ORDER denying 6 Motion to Expedite. Although the motion includes a certificate indicating that petitioner's counsel "communicated" with the U.S. Attorney's Office civil chief about the "contents of the motion" and that "the concerns raised in the motion were not addressed prior to the filing of this motion," the certificate does not describe whether petitioner's counsel made any efforts to "resolve any disputed matter" with respect to the relief requested or mention "the specific efforts to fulfill this duty" in accordance with D.C.Colo.LCivR 7.1. In other words, the certificate does not reflect that petitioner's counsel has abided by the duty to make reasonable, good faith efforts to confer prior to filing the motion to expedite briefing. ORDER denying 9 Motion to Expedite. The Court adheres to its initial 14-day deadline following service for respondents to show cause why the petition should not be granted. The Court recognizes that petitioner's right to practice his religion is very important and should be respected to the maximum extent possible, and encourages respondents to address the identified concerns. However, these concerns are distinct from the issues encompassed in this case. And while the Court further encourages respondents to accelerate its briefing as much as possible, it finds that respondents' position is reasonable in light of the overwhelming number of cases that the U.S. Attorney's Office in Colorado is already briefing on an expedited basis (including this one). The difference between the deadline in the proposed order and the response deadline set by this Court is not vast, and respondents will have to respond next week regardless. By Judge R. Brooke Jackson on 2/26/2026. Text Only Entry (rbjlc9, ). (Entered: 02/26/2026)
