MINUTE ORDER issued by the Courtroom Deputy for District Judge Dena M. Coggins on 3/12/2026: The court has further reviewed Petitioner's 1 Petition for Writ of Habeas Corpus and 4 Motion for a Temporary Restraining Order, as well as Respondents' 9 Opposition to Petitioner's 4 Motion for a Temporary Restraining Order and Petitioner's 10 Reply thereto. The court recently considered the same issues raised in the 1 Petition in a substantially similar case in Maciel v. Noem, No. 1:26-cv-01318-DC-CKD, 2026 WL 496948 (E.D. Cal. Feb. 23, 2026), wherein the court found that the Petitioner "was entitled to a bond hearing under [8 U.S.C. §] 1226(a)" and therefore issued a temporary restraining order requiring Petitioner's immediate release, and requiring Respondents to provide Petitioner with a bond hearing pursuant to 8 C.F.R. § 1236.1(c)(8) should they seek to re-detain him. Maciel, 2026 WL 496948 at *4, *6. Accordingly, the parties are hereby ordered to file supplemental briefs on or before 12:00 PM on 3/18/2026 addressing whether there are any factual or legal issues in this case that materially distinguish it from Maciel, and whether Petitioner is entitled to the same relief here as in Maciel. MINUTE ORDER issued on 4/8/2026 by the Courtroom Deputy for District Judge Dena M. Coggins: On 2/17/2026, Petitioner filed a 1 Petition for Writ of Habeas Corpus seeking an order requiring Petitioner's immediate release, or in the alternative, requiring that Respondents provide Petitioner with an individualized bond hearing at which his eligibility for release must be considered. (Doc. No. 1 at 11.) On that same day, Petitioner filed a 4 Motion for a Temporary Restraining Order prohibiting Respondents from transferring or removing Petitioner during the pendency of these proceedings. (Doc. No. 4 at 10.) On 3/17/2026, Respondents filed a 14 Motion to Dismiss informing the court that Petitioner had been released from immigration detention on bond and moving the court to dismiss Petitioner's Habeas Petition as moot. (Doc. Nos. 14, 14-1.) On 3/25/2026, Petitioner filed an 16 Opposition to Respondents' Motion to Dismiss arguing that his Petition is not moot because he "would move the Court to enter an order directing Respondents to not re-arrest Petitioner unless there is a final order of removal, or if Respondents elect to re-arrest Petitioner otherwise, then to provide Petitioner with a bond determination hearing within 7 days of such arrest." (Doc. No. 16 at 2.) Petitioner did not seek that relief in either his 1 Petition or 4 Motion for a Temporary Restraining Order. Indeed, by his release Petitioner has received all the relief sought by his 1 Petition and 4 Motion. Accordingly, the court GRANTS Respondents' 14 Motion to Dismiss Petitioner's Habeas Petition and DENIES without prejudice Petitioner's 1 Petition for Writ of Habeas Corpus, 4 Motion for a Temporary Restraining Order, and 11 Motion to Accept Late Filing, as having been rendered MOOT by his release.
