ORDER FOR STATUS UPDATE by District Judge Sarah M. Davenport. On February 17, 2026, Petitioner filed a request for a writ of habeas corpus pursuant to 28 U.S.C. § 2241. Respondents opposed the motion and represented that they have been making "diligent efforts to find a country that will accept Petitioner and in which he will be safe." Doc. 10 at 2. Respondents acknowledged that Petitioner's detention was "manifestly past the six-month point," but asked the Court to permit continued detention while DHS pursued removal efforts. Petitioner has now been in Respondents' custody for ten months. Assistant Field Officer Director Francisco Ruiz's declaration states that Enforcement and Removal Operations have made numerous attempts to obtain Petitioner's travel documents from India, but it does not appear those efforts have been fruitful. The declaration does not provide information as to whether DHS has identified or been in contact with a third country for removal. The Court ORDERS Respondents to file a status report no later than May 18, 2026, informing it of whether they have made progress in effectuating Petitioner's removal since filing their response.
