MINUTE ORDER Clarifying ECF No. 7 . On February 26, 2026, the Court ordered that "Petitioner is entitled to an individualized bond hearing before an immigration judge." In response to the Parties' Status Reports, (see ECF Nos. 8 (Petitioner's Status Report), 9 (Respondents' Status Report)), the Court clarifies that Petitioner's individualized bond hearing was not ordered under 8 U.S.C. § 1226(a), but rather as required to comport with due process under the United States Constitution in light of Petitioner's prolonged mandatory detention. Because Matter of Q Li, 29 I&N Dec. 66 (BIA 2025), does not apply here, the Immigration Judge SHALL CONDUCT an individualized bond hearing, and the Government SHALL BEAR the burden of establishing by clear and convincing evidence that Petitioner is a danger to the community or a flight risk if released.
