Because of the Petitioner's assertion that he was moved from the State of Rhode Island in violation of this Court's clear order of 2/16/26 (ECF No. 3 ), the Respondents are ordered to release the Petitioner immediately from ICE custody. His release must be accomplished no later than 7 p.m. tonight, February 18, 2026. The Respondents are to provide this Court with a status report no later than 8 p.m. tonight, February 18, 2026, indicating that he has been released. Respondents are further enjoined from re-detaining the Petitioner unless they first provide 72 hours' written notice to the Court and to Petitioner's counsel stating the reason for re-detention and the proposed facility. TEXT ORDER. Although the Respondents represent that the Petitioner has been released and thus contend that the Petition for Habeas Corpus is moot, the Court declines to dismiss the action at this time. The Respondents are ordered to respond to the Petitioner's assertions that he was removed from the District of Rhode Island in clear violation of this Court's February 16, 2026 Order (ECF No. 3 ). Court orders are not advisory or mere suggestions; they are binding directives. Intentional failure to comply is a matter the Court is obligated to address. Accordingly, on or before February 24, 2026, the Respondents shall provide to the Petitioner and file with the Court (1) any and all documents and communications related the dissemination, receipt, or discussion about this Court's February 16, 2026 Order; (2) the names, agencies, and positions of all individuals involved in, consulted regarding, or informed of the decision to remove the Petitioner from the District of Rhode Island; and (3) all documents created between the issuance of the Courts February 16, 2026 Order and the Petitioner's release on February 18, 2026, relating to the Petitioners custody, transfer, or release.
