TEXT ORDER: According to petitioner, respondents are presently detaining her under the mandatory detention provisions of 8 U.S.C. § 1225. (ECF No. 1 p. 13.) Under the recent decision in Bethancourt- Soto v. Soto, et al., No. 25-cv-16200, __ F. Supp. 3d __, 2025 WL 2976572 (D.N.J. Oct. 22, 2025), as petitioner was apprehended inside the United States after residing here for an extended period, this Court finds that she should be detained under 8 U.S.C. § 1226, which requires an opportunity to seek bond. Accordingly, respondents are PROHIBITED from moving petitioner outside of the District of New Jersey until further order of this Court. It is further ORDERED that the immigration court shall provide petitioner with a bond hearing no later than 5:00p.m. on February 20, 2026. Respondents shall file a letter on the docket indicating the date and time of the bond hearing by 12:00 p.m. on February 19, 2026. If respondents contend that Bethancourt-Soto does not control, for example, because it is factually distinguishable, they shall file an expedited answer to the Petition by 5:00 p.m. on February 20, 2026, and petitioner shall file any reply by 5:00 p.m. on February 23, 2026.
