Judge Brian E. Murphy: ELECTRONIC ORDER entered. This Petition is GRANTED. “Respondents submit that the legal and factual issues presented in this Petition appear similar to those examined by another session of this Court in Siguenza v. Moniz, No. 25-cv-11914-ADB, 2025 WL 2734704, at *3 (D. Mass. Sept. 25, 2025), where [Judge Burroughs] concluded that ‘[8 U.S.C.] [s.] 1231(a)(6) no longer authorizes [p]etitioner’s detention because there is no significant likelihood that he will be removed in the reasonably foreseeable future.’” Dkt. 8 at 1. Petitioner alleges that he has been detained for more than twelve months, based on a final order of removal issued in 2008; that the Government has since been unable to obtain travel documents to effect his removal; and that the Government is therefore unlikely to remove him in the foreseeable future. Dkt. 1 at 1, 7-8. In light of Respondents’ answer, the Court takes Petitioner’s allegations as true.Respondents ask the Court to limit relief “to an Order that ICE release Petitioner pursuant to an Order of Supervision.” Dkt. 8 at 2. Presumably, Petitioner was released on an Order of Supervision following his statutory removal period. See 8 U.S.C. [s.] 1231(a)(3); 8 C.F.R. [ss.] 241.4, 241.13. However, Respondents have not provided the Court with either the preexisting Order of Supervision or any prospective Order of Supervision.Accordingly, Petitioner is hereby ORDERED released. To the extent Petitioner was subject to an Order of Supervision prior to his most recent ICE detention, ICE may reinstate that preexisting order.
