Counsel for respondents shall promptly enter notices of appearance. MINUTE ORDER signed by District Judge Kirk E. Sherriff on 3/19/2026: The 2 motion for temporary restraining order is denied. An immigration judge ordered petitioner removed but granted withholding of removal to Gambia in 2023. Doc. 1, Ex. 1. Petitioner was thereafter released on an order of supervision. See Doc. 13-1. ICE revoked petitioner's release on January 13, 2026 because his case was "under current review... for the issuance of a travel document from a third country." Doc. 13-1 at 5. 8 C.F.R. § 241.13(i)(2) permits revocation of release "if, on account of changed circumstances, [ICE] determines that there is a significant likelihood that the alien may be removed in the reasonably foreseeable future." 8 C.F.R. § 241.13(i)(2); see Nguyen v. Warden, No. 1:26-CV-00350-JLT-EPG-HC, 2026 WL 629729, at *2-5 (E.D. Cal. Mar. 6, 2026). Petitioner asserts in his 1 petition and 2 motion that he was unlawfully detained, but he fails to address this regulation or cite any case that is on point. Petitioner has not met his burden, on the present motion, to show that he is likely to succeed on the merits of his claim. This matter is referred to the assigned magistrate judge for the preparation of findings and recommendations on the petition or other appropriate action. (JV) (Entered: 03/19/2026)

MINUTE ORDER signed by District Judge Kirk E. Sherriff on 4/13/2026: (Text Only Entry): Respondents' 17 motion to modify the Court's stay of transfer (see Doc. 5) is granted. Respondents indicate that they have scheduled petitioner for removal to a third country - Ghana. Doc. 17-1, Schultz Decl. at 6. The 1 petition and 2 motion for temporary restraining order challenged only petitioner's detention and did not assert any claim with respect to petitioner's removal to a third country. See Docs. 1, 2. Petitioner argues in his 18 opposition that he cannot be removed to Ghana unless his grant of withholding of removal to Gambia is terminated pursuant to 8 C.F.R. § 208.4(f). See Doc. 18 at 3-5. Even if that argument were properly before the Court, it has no merit. Withholding of removal relief is "country-specific." Johnson v. Guzman Chavez, 594 U.S. 523, 536 (2021) ("If an immigration judge grants an application for withholding of removal, he prohibits DHS from removing the alien to that particular country, not from the United States."); see also 8 C.F.R. § 208.22. The stay of transfer is partially lifted, in that respondents may transfer petitioner out of the district to effectuate his removal to a third country - Ghana.
