ENDORSED ORDER. Text of Order: The issues presented by this habeas petition appear materially similar to those presented by Jimenez v. FCI Berlin, Warden, --- F. Supp. 3d ----, 2025 WL 2639390 (D.N.H. Sept. 8, 2025). As such, it appears that petitioner is entitled to an immediate bond hearing before an IJ pursuant to issuance of a writ of habeas corpus. See Lamidi v. FCI Berlin, Warden, Civ. No. 25-cv-297 (D.N.H. Sept. 15, 2025) (doc. no. 14). Accordingly, respondents are ORDERED to show cause (no later than noontime on September 23, 2025) why this court should not grant the petition. Petitioner's reply is due by 4 p.m. on September 23, 2025. The parties are requested to append to their filings such documents as may be reasonably obtained that support their arguments. A hearing on the petition shall be scheduled to occur at 4:30 p.m. on September 23, 2025. Should counsel for petitioner waive his presence at tomorrows hearing, that hearing shall occur via video.
