However, Petitioner commenced this case by filing his Petition for Writ of Habeas Corpus using his full name and did not file the documents he asks the Court to seal in accordance with Local Rule IA 10-2. So, his full name and the information he seeks to keep confidential is currently accessible to the public. SeeFed. R. Civ. P. 5.2.(c)(2).To preserve Petitioner's interest in keeping his identity confidential, the Court will order the Clerk to provisionally seal this case in its entirety, pending further order of the Court on the Motion for Protective Order, after notice and an opportunity to be heard is provided to Respondents.Therefore, IT IS HEREBY ORDERED that the Clerk of Court is instructed to SEAL this case in its entirety, pending further order of the Court. MINUTE ORDER IN CHAMBERS of the Honorable Judge Richard F. Boulware, II on 10/8/2025.Pending before the Court is Petitioner's 3 Motion for Protective Order, in which he seeks leave to proceed under a pseudonym and to seal documents containing his personally identifiable information, based on concerns about retaliatory harm if information related to his identity and asylum application is accessible to the general public. Respondents have not opposed or objected to Petitioner's Motion.In the Ninth Circuit "a party may preserve his or her anonymity in judicial proceedings in special circumstances when the party's need for anonymity outweighs prejudice to the opposing party and the public's interest in knowing the party's identity." Does I thru XXIII v. Advanced Textile Corp., 214 F.3d 1058, 1068 (9th Cir. 2000). Having considered the relevant factors, and the fact that Respondents do not object to Petitioner proceeding anonymously, the Court finds Petitioner's need for anonymity outweighs the public interest in knowing his identity. The Court will therefore grant the Motion and unseal this case, while maintaining the seal of all filings that contain Petitioner's personally identifiable information.Therefore, IT IS HEREBY ORDERED that Petitioner's 3 Motion is GRANTED.IT IS FURTHER ORDERED that the Clerk of Court is instructed to: (1) SUBSTITUTE Petitioner's full name with the pseudonym E.C. on the docket, including the docket text of each of Petitioner's fillings, and on the case caption;(2) UNSEAL this case, with the following documents to REMAIN UNDER SEAL: 1. ECF No. 1; 2. ECF No. 2;3. ECF No. 3;4. ECF No. 4-1 (EXHIBITS ONLY); 5. ECF No. 13-1 and 13-2 (EXHIBITS ONLY).
