TEXT ORDER: This matter comes before the Court upon Petitioner Hugo Alejandro Caldera Ferrer's Petition for Writ of Habeas Corpus. D.E. [1-2] ("Petition"). Petitioner alleges he is unlawfully detained by immigration authorities at Delaney Hall Detention Facility ("Delaney Hall") in Newark, New Jersey and seeks release from custody. Id. In the interests of justice, the Court substitutes Luis Soto, Warden of Delaney Hall, Petitioner's immediate custodian, as the respondent in this matter. See, e.g., Burns v. Weber, No. 09-5119, 2010 WL 276229, at *5 (D.N.J. Jan. 19, 2010); Jackson v. Chatman, 589 F. App'x 490, 491, n.1 (11th Cir. 2014). And, in accordance with Rule 4 of the Rules Governing 2254 Cases ("Habeas Rule 4"), applicable to § 2241 cases through Rule 1(b), scope of the Rules, this Court has screened the Petition for dismissal and determined dismissal without a full answer is not warranted. Accordingly, Respondents shall file an expedited answer to the Petition within 7 days. Pursuant to the All Writs Act, 28 U.S.C. § 1651, Petitioner shall not be transferred from New Jersey during the pendency of this habeas proceeding. So Ordered by Judge Evelyn Padin on 2/13/2026.
