ORDER/NOTICE TO ATTORNEY. Respondents are directed to file an answer to petitioner's petition for a writ of habeas corpus by no later than February 16, 2026, certifying the true cause and proper duration of petitioner's confinement and showing cause why the writ should not be granted in this case. If petitioner intends to file a reply to respondents' answer, petitioner must do so by no later than February 18, 2026. Respondents are ENJOINED from moving petitioner outside of Minnesota until further order of the Court, so that petitioner may consult with counsel while the Court is considering the petition, and so that there is no risk that removal of petitioner from Minnesota will deprive this Court of jurisdiction over the petition. If petitioner has already been removed from Minnesota, respondents are ORDERED to return petitioner to Minnesota no later than February 15, 2026 at 9:00 am. See Order for details. ORDER overruling 13 respondents' objection to Report and Recommendation. The 12 Report and Recommendation is ADOPTED insofar as it recommends granting the amended petition for habeas corpus based on respondents' violation of 8 C.F.R. &# 167; 241.13(i)(2). 7 Petitioner's amended petition for habeas corpus is GRANTED IN PART and DENIED IN PART. Specifically, the Court: a. ORDERS respondents to release petitioner from custody in accordance with the conditions previously imposed by 4:00 pm on March 7, 2026. If petitioner is not in Minnesota, respondents must first return petitioner to Minnesota. The remainder of petitioner's petition is DENIED WITHOUT PREJUDICE. See Order for details.
