MINUTE ORDER signed by District Judge Kirk E. Sherriff on 2/16/2026: The petition, which notes that petitioner was ordered removed on October 23, 2025, seeks petitioner's release from detention. Doc. 1. Petitioner's detention is "presumptively reasonable" as she has been detained for less than six months after the issuance of the final order of removal, see Zadvydas v. Davis, 533 U.S. 678, 701 (2001), and petitioner has not rebutted this presumption. The motion for temporary restraining order is denied, as petitioner has not established, at this time, a likelihood of success on the merits of her claim. See Winter v. Nat. Res. Def. Council, Inc., 555 U.S. 7, 20 (2008); Stuhlbarg Int'l Sales Co. v. John D. Bush & Co., 240 F.3d 832, 839 n.7 (9th Cir. 2001) (noting standards for issuing a temporary restraining order and a preliminary injunction are "substantially identical.").
