TEXT ORDER: The Court having reviewed the parties filings (ECF Nos. 1-2, 7), and the Government having admitted that this matter is not meaningfully distinguishable from this Court's prior decision in Valerio v. Joyce, No. 25-17225, 2025 WL 3251445 (D.N.J. Nov. 21, 2025), this Court holds that Petitioner is subject to detention only under 8 U.S.C. § 1226(a). The Government is therefore ORDERED to provide Petitioner with a bond hearing pursuant to § 1226(a) within seven days at which an Immigration Judge shall make an individualized determination of whether Petitioner presents a flight risk or danger to the community. The Government shall inform the Court of the outcome of that hearing within three days of the Immigration Judge's decision. Petitioner's motion seeking a temporary restraining order (ECF No. 2 ) is DENIED WITHOUT PREJUDICE in light of this Order. So Ordered by Judge Zahid N. Quraishi on 2/18/2026.
