TEXT ORDER. The Court is in receipt of Respondents' letters regarding the status of Petitioner's motion to reopen and requesting clarification with respect to the Court's earlier order to show cause. ECF Nos. 7, 8. In that regard, the Court notes that the "previous scheduling order" that the Court referenced as void in its minute entry from the 9/26/25 status conference (ECF No. 6) was the "Order to Show Cause" that directed that Petitioner remain in this District until a "Show Cause" hearing could be held. As the Order to Show Cause is no longer in effect, the Court declines to interfere with Respondents' authority to transfer Petitioner as warranted. Petitioner is directed to submit a brief status letter in this matter on or before Friday, December 5, 2025 informing the Court whether he intends to file an amended petition or if the Court should dismiss the petition as moot. TEXT SCHEDULING ORDER. At approximately 8 AM on Monday, November 24, 2025, Respondent notified the Court and Petitioner that on Thursday, November 20, 2025, an Immigration Judge had denied Petitioner's motion to reopen his removal proceedings. ECF No. 7. After the Court directed Petitioner to provide a status update, counsel for Petitioner indicated that he would be filing a motion for a temporary restraining order later that same day. ECF No. 10. At 1 PM on Wednesday, November 26, 2025, Petitioner filed a motion for a temporary restraining order [ECF No. 13] and a motion to expedite consideration of that motion [ECF No. 14]. Despite the requirements of Local Rule 7(d)(1), counsel did not personally deliver courtesy copies of the motion papers to chambers, or contact chambers by telephone to request a waiver of this requirement. Loc. R. Civ. P. 7(d)(1). In any event, the Court has reviewed Petitioner's papers. A status conference in this matter is set for Monday, December 1, 2025 at 2 PM in Courtroom 2 at the Keating Federal Building, 100 State Street, Rochester, New York before Hon. Meredith A. Vacca.
