ENDORSED ORDER : BRIEFING ORDER and TRANSPORT ORDER. Text of Order: The issues presented by this habeas petition appear materially similar to those presented by Jimenez v. FCI Berlin, Warden, --- F. Supp. 3d ----, 2025 WL 2639390 (D.N.H. Sept. 8, 2020). As such, it appears that petitioner is entitled to an immediate bond hearing -- either before this court pursuant to its inherent authority to release habeas petitioners pending a decision on the merits, or before an IJ pursuant to issuance of a writ of habeas corpus. See Gomes v. US Dep't of Homeland Sec., Acting Sec'y, 460 F. Supp. 3d 132, 144 (D.N.H. 2020); Lamidi v. FCI Berlin, Warden, Civ. No. 25-cv-297 (D.N.H. Sept. 15, 2025) (doc. no. 14). Respondents shall submit their responsive pleading to the petition no later than 5:00 p.m. on September 21, 2025. Petitioner's reply is due by midnight on September 21, 2025. The parties are requested to append to their filings such documents as may be reasonably obtained that support their arguments. Text of Order: In the government's "Abbreviated Response to Habeas Petition and Request to Proceed Without Additional Briefing or Argument," (doc. no. 13), the government acknowledges that this matter is controlled by the court's reasoning in Jimenez, --- F. Supp. 3d ----, 2025 WL 2639390 (D.N.H. Sept. 8, 2025), and that the court's reasoning in this case "controls the result in this case if the Court adheres to the reasoning in that decision." Doc. no. 13 at 2. Having considered the government's response (doc. no. 13), the court sees no reason to depart from the analysis in Jimenez. Accordingly, the petition for a writ of habeas corpus (doc. no. 1) is granted for the reasons stated in Jimenez. Respondents are ORDERED to immediately provide Moran with a bond hearing before an IJ pursuant to 8 U.S.C. 1226, in no event later than seven days from the date of this order's issuance. Respondents shall file a status report on or before September 29, 2025, confirming that Moran has received a bond hearing before an IJ pursuant to 8 U.S.C. 1226 and describing the result of such bond hearing.
