ORDER: The Court is in receipt of Respondent's Status Report Pursuant to the Court's March 19, 2026, Order (ECF No. 21 ), ECF No. 23 . In light of Respondent's representations that "ICE received Petitioner's passport from the Consulate of Poland on March 19, 2026" and Respondent is "not aware of any other issues preventing Petitioner's voluntary departure tomorrow, March 21, 2026," id. at 1, Respondent's Expedited Motion to Vacate Order Directing Respondent Not to Remove Petitioner From the District of Colorado and the United States (ECF No. 6), ECF No. 20, is GRANTED, and the Court's February 17, 2026 order that "Respondents SHALL NOT REMOVE Petitioner from the District of Colorado or the United States unless or until this Court or the Court of Appeals for the Tenth Circuit vacates this Order," ECF No. 6, is hereby VACATED. See, e.g., Elephant Butte Ir. Dist. of N.M. v. U.S. Dep't of Interior, 538 F.3d 1299, 1306 (10th Cir. 2008) ("[E]very order short of a final decree is subject to reopening at the discretion of the district judge."). The Court orders the Respondents to file a Status Report within five days to confirm Petitioner's departure. In light of the expedited nature of the proceedings in this case, the Court orders Respondent's counsel to facilitate service of this order on Petitioner prior to his departure on March 21, 2026, and file a certificate of service.
