ORDER TO SHOW CAUSE: Christian Eriberto Encalada Pillco petitions for a writ of habeas corpus pursuant to 28 U.S.C. § 2241, challenging his ongoing detention by U.S. Immigration and Customs Enforcement. "Whenever a § 2241 habeas petitioner seeks to challenge his present physical custody within the United States, he should name his warden as respondent and file the petition in the district of confinement." Rumsfeld v. Padilla, 542 U.S. 426, 447 (2004). It is the petitioner's burden to establish that venue is proper. Gulf Ins. Co. v. Glasbrenner, 417 F.3d 353, 355 (2d Cir. 2005). The petition states both that Encalada Pillco is detained in Brooklyn, New York, and in Newark, New Jersey. Pet. ¶¶ 15, 42, 53. Petitioner is ordered to show cause, no later than 5 p.m. on February 13, why venue lies in this district, indicating his location at the time this petition was filed. Petitioner is directed to serve his petition, his motion, and this order on the government by end of day on February 12. Ordered by Judge Eric R. Komitee on 2/11/2026. (SPE)
