MINUTE ORDER signed by District Judge Daniel J. Calabretta on 2/11/2026: Based on the time Petitioner has already been in custody and the lengthy delay in seeking a temporary restraining order, the Court finds that Petitioner has not established irreparable harm to warrant issuance of a temporary restraining order. See Oakland Trib., Inc. v. Chron. Pub. Co., 762 F.2d 1374, 1377 (9th Cir. 1985). The Court therefore converts the Motion for Temporary Restraining Order to a Motion for Preliminary Injunction. Respondents are ORDERED to file an Opposition on or before February 25, 2026. Petitioner may file a Reply on or before March 4, 2026. This matter is not set for a hearing though the Court may set one should it later be determined that a hearing is necessary. Petitioner's counsel is DIRECTED to send a copy of the petition and this order as well as provide the Petitioner's full name and A number to the US Attorney's Office by February 11, 2026, at 5:00 P.M., at their email usacae.ecf2241-imm@usdoj.gov.
