STAY OF REMOVAL AND ORDER TO SHOW CAUSE: The Parties must carefully read the full contents of the attached Order to Show Cause and comply with all directives. As set forth in the attached Order:1. The parties are ORDERED to appear before this Court for a hearing on the Petition on February 13, 2026 at 2:00 p.m. in Courtroom 1040 of the Alfonse DAmato United States Courthouse, 100 Federal Plaza, Central Islip, New York, 11722;2. Respondents shall produce Petitioner for in-person appearance at the hearing;3. Within 24 hours of issuance of this Order, Petitioner's counsel must: (1) serve Respondents with a copy of the petition and accompanying papers, along with a copy of this Order, by email to the United States Attorney's Office for the Eastern District of New York and by overnight mail, and (2) promptly file proof of such service on the docket. Counsel for Respondents shall promptly enter notices of appearance. ORDER. The Court amends its February 10, 2026 Stay of Removal and Order to Show Cause as follows (ECF No. 3 ):The parties are ORDERED to appear before this Court for a hearing on the Petition on February 12, 2026 at 2:00 p.m. in Courtroom 1040 of the Alfonse D'Amato United States Courthouse, 100 Federal Plaza, Central Islip, New York, 11722.Respondents are required to produce the Petitioner for in-person appearance at the February 12, 2026 hearing.By 8 p.m. tonight, the parties must notify the Court in writing of any conflicts with the rescheduled hearing time.Additionally, by February 12, 2026 at 10:00 a.m., the parties shall address the impact, if any, of the ICE Form I-210, Voluntary Departure and Verification of Departure and Form I-210A Addendum to DHS Form I-210 - Alien Declaration provided in Respondents' submission at ECF No. 8 at 12-15 on Respondents' reliance on 8 U.S.C. § 1225(b)(2) as the basis for detention and Petitioner's argument that his detention in ICE custody is governed by 8 U.S.C. § 1226(a). Following the hearing, if the Court orders Petitioner to remain in detention, U.S. Immigration and Customs Enforcement shall return him under safe and secure custody to the Metropolitan Detention Center in Brooklyn. Alternatively, if the Court grants the petition and orders Petitioner released from detention, U.S. Immigration and Customs Enforcement shall immediately process Petitioner for release from the Court in accordance with any orders of the Court that may issue at that time. It is further ordered that U.S. Immigration and Customs Enforcement shall bear the costs of implementing the terms of this order.Ordered by Judge Nusrat J. Choudhury on 2/11/2026. (CQTH)
