MINUTE ORDER issued by Courtroom Deputy for District Judge Daniel J. Calabretta on 5/6/2026: The Court has read and review the Status Report filed by Respondents (ECF No. 20 ) and the Response filed by Petitioner (ECF No. 21 ). The Court's prior order directing that Petitioner be provided with a bond hearing does not prevent the Government from seeking to effectuate Petitioner's removal and, if Petitioner is no longer in Respondents' custody, the Court's order that Respondents provide Petitioner a bond hearing is moot. However, if Petitioner is not removed before the imposed deadline for Respondents to provide a bond hearing, Respondents are required to comply with the Court's prior order. To the extent Respondents believe there is competent evidence establishing that there has been a change in circumstances such that modification is warranted, Respondents must first file a motion. In prior cases, the United States Attorney's Office has taken the position that the Executive Office of Immigration Review, which conducts bond hearings, is not a proper party to these habeas actions. In light of that position, the Court has subsequently included instructions in its more recent orders that should Respondents fail to provide a petitioner with a bond hearing as ordered, they shall release the petitioner. The inclusion of such language appears appropriate here, and the Court will modify its prior order accordingly. As such, if Petitioner is not provided a bond hearing in the time prescribed by the Court's prior order (see ECF No. 18 ), Respondents are ORDERED to immediately release Petitioner from their custody absent any further order by this Court.
