ORAL ORDER: On February 5, 2026, Petitioner filed a Petition for Writ of Habeas Corpus pursuant to 28 U.S.C. § 2241 and an Emergency Motion for Immediate Release (Dkts. 1, 2 ). In the filings, Petitioner represents that he is currently detained in the detention center located at 508 Waterworks Rd. in Farmville, Virginia. Petitioner is thus detained within the jurisdiction of the United States District Court for the Eastern District of Virginia. Accordingly, this court lacks jurisdiction to consider this Petition and Emergency Motion. See United States v. Morgan, 305 F. App'x 61, 62 (4th Cir. 2008) ("A § 2241 petition... must be brought in the district of incarceration."). Petitioner's case should be transferred to the Eastern District of Virginia in the interests of justice. See 28 U.S.C. § 1631; United States v. Mullinax, 706 F. App'x 134, 134 (4th Cir. 2017). The Clerk is ordered to transfer this action expeditiously to the United States District Court for the Eastern District of Virginia and provide a copy of this order to Petitioner.
