By Deputy Clerk: Karen Walker.On February 10, 2026, the Court screened the petition for writ of habeas (ECF No. 1 -1, 4 ("Petition")), appointed the Federal Public Defender ("FPD") as counsel, and granted FPD 14 days to file an amended petition or indicate that an amended petition is unnecessary. (ECF No. 3 at 2 ("Screening Order").) The Court ordered Respondents to respond to the amended petition in 14 days. (Id. at 3.) FPD did not file an amended petition. The Court now orders Respondents to file a response to the filed Petition (ECF No. 4 ) by Thursday, March 5. Petitioner will then have seven days to file a reply. MINUTE ORDER IN CHAMBERS of the Honorable Judge Miranda M. Du on 3/25/2026. Petitioner filed a First Amended Petition for writ of habeas corpus. (ECF No. 10 (FAP).) Respondents filed a response (ECF No. 18) and Petitioner replied (ECF No. 19). The Court identifies two unresolved factual disputes. First, the parties dispute whether Petitioner faced removal flights to Cuba or to Mexico. (ECF Nos. 10 at 2; 18 at 1; 19 at 2, 4.) Neither party provides evidence supporting either conclusion. For example, Respondents cite to Exhibit C to substantiate their claim that they attempted to remove Petitioner to Cuba. (ECF No. 18 at 1 (citing ECF No. 18-4).) However, the cited exhibit refers only to Petitioner's removal flight but does not identify whether that flight was to Cuba or Mexico. (ECF No. 18-4 at 2.) Second, the parties dispute whether Petitioner is receiving his medication in detention. (ECF Nos. 10 at 2, 5; 18 at 2; 19 at 7.) Similarly, neither party provides evidence to fully substantiate this disputed fact. For example, Petitioner filed a generated document listing Petitioners prescribed medications with Petitioners handwritten statement without medication since 02/22/26. (ECF No. 15-1.) In executing its habeas corpus jurisdiction, the Court shall "summarily hear and determine the facts" including by fashioning "methods for securing facts where necessary." Harris v. Nelson, 394 U.S. 286, 299 (1969) (quoting 28 U.S.C. § 2243). The Court therefore orders Respondents to supplement their response with (1) evidence that the removal attempts referenced in Exhibit C were to Cuba as Respondents represent in their response and any notice to Petitioner as to the country to which he would be removed; and (2) evidence as to the status of Petitioners prescribed medications since February 22, 2026. The supplement must be filed by noon on Monday, March 30, 2026. The Court will then determine whether further briefing or a hearing is necessary to resolve the FAP.
