The Court defers ruling on Petitioners' requests for immediate release and a custody redetermination at this time. OPINION - Having considered the entire record in this case and the relevant legal principles, the Court holds that Petitioners are entitled to two pieces of injunctive relief. First, the Court finds that Mr. Marroquin may not be detained pursuant to § 1225, but rather is detained pursuant to § 1226(a). Likewise, in the event that Respondents elect to re-detain Mr. Del Cid in the future, and in the event that he still has SIJ Status and no criminal record at that time, he may not be det ained pursuant to § 1225, but rather § 1226(a) alone. Second, the Court finds that Mr. Marroquin is entitled to a bond hearing under § 1226(a) and all related legal principles within seven (7) days of this Opinion. If Respondents re-de tain Mr. Del Cid in the future, and if he still has SIJ Status and no criminal record at that time, Respondents shall likewise provide him with a bond hearing under § 1226(a) and all related legal principles within seven (7) days of his re-detention. The Court finds that Petitioners' other claims are unavailing at this time. An appropriate Order follows, and as more fully stated in said Opinion. Signed by Judge Stephanie L. Haines on 10/23/2025.
